1. Who we are
The ACC platform and the website at acornteck.com(the “Service”) are operated by ACORN CREEK CAPITAL LLC(“we”, “us”, “our”). By creating an account or using the Service you agree to these Terms of Service and to the Privacy Policy published on this website. If you do not agree, do not use the Service.
2. Accounts
Registration requires a valid email address, a mobile phone number, and a password. You are responsible for keeping your credentials confidential and for all activity under your account. You must be at least 18 years old and, where you act for a business, authorized to bind that business.
We may suspend or terminate accounts that breach these terms, create risk for the Service or its carrier partners, or remain unused for an extended period.
3. Acceptable use of messaging
The Service routes application-to-person (A2P) messages across third-party carrier networks. You agree that traffic you submit:
- complies with the laws and carrier rules of every destination it is sent to, including sender registration and content requirements;
- is sent only to recipients who have given the consent required for that traffic class — promotional messages require documented opt-in and a working opt-out mechanism;
- contains no unlawful, fraudulent, or deceptive content, including phishing, artificially inflated traffic (AIT), or impersonation of third parties;
- respects quiet hours, sender identity, and category restrictions that apply in the destination market.
We may filter, delay, or refuse traffic that appears to violate this section, and may pass on carrier fines caused by your traffic.
4. Service levels and delivery
Message delivery depends on third-party networks we do not control. Delivery receipts (DLRs) are forwarded as received from carriers and are evidence of carrier acknowledgement, not of handset display. Published throughput, latency, and delivery figures describe typical observed performance and are not a guarantee.
5. Fees
Messaging is billed per message part at the rates issued to your account. Rates vary by destination, encoding, sender class, and carrier surcharges and may change with corridor conditions. Taxes are your responsibility where applicable.
6. API and platform use
API credentials are issued per account and must not be shared. You may not probe, overload, resell, or reverse engineer the Service except as permitted by law. We may set and adjust throughput ceilings to protect the platform and its routes.
7. Intellectual property
The Service, including its software, design, and content, remains our property or that of our licensors. You retain rights to the content of messages you submit and grant us the license needed to route them.
8. Disclaimers and liability
The Service is provided “as is” without warranties of any kind to the extent permitted by law. To the maximum extent permitted by law, our aggregate liability arising out of the Service in any twelve-month period is limited to the fees you paid to us for the Service in that period, and neither party is liable for indirect or consequential damages.
9. Changes
We may update these terms by publishing a revised version on this page with a new version date. Material changes will be notified to account holders by email. Continued use after the effective date constitutes acceptance.
10. Governing law
These terms are governed by the laws of the State of Delaware, United States of America, without regard to conflict-of-law rules. Disputes are subject to the courts of that jurisdiction.
